Terms of Service

1. Parties

These Terms of Service ("Terms") govern your use of certificatesofconformity.co.za (the "Platform"), operated by LinkDaddy LLC, a Florida limited liability company, 509 N Prescott Avenue, Suite B, Clearwater, Florida 33755, United States ("LinkDaddy", "we", "us"). By creating an account or using the Platform, you agree to these Terms.

2. Description of Service

The Platform provides a digital infrastructure service for hashing, vaulting, and publicly verifying Certificates of Conformity. LinkDaddy LLC does not issue Certificates of Conformity, does not inspect goods, and does not certify compliance with any standard. The Platform is a neutral infrastructure operator only.

3. Fees and Payment

Use of the Platform requires payment of a one-time onboarding fee (R1,997 ZAR) and a per-shipment minting fee calculated as a percentage of the declared CIF value of the import. An optional vault subscription (R499 ZAR per month) is available for extended document retention. All fees are non-refundable once the minting transaction has been completed and the verification URL has been issued. Payments are processed by Stripe, Inc. in ZAR.

4. User Obligations

You represent and warrant that:

• All information you provide, including CIF values, HS codes, and importer details, is accurate and matches your SAD500 declaration.
• The CoC PDF you upload is a genuine document issued by an accredited conformity assessment body.
• You are authorised to upload and register the document on behalf of the importer of record.
• You will not use the Platform to register fraudulent, forged, or altered documents.

5. Permanent Public Registry

You acknowledge that once a CoC is minted, the SHA-256 hash, metadata, and verification URL become part of a permanent public registry. This record cannot be deleted. The verification URL at /v/{hash}/ will remain publicly accessible for the duration of the Platform's operation. This permanence is a feature, not a bug — it is what makes the verification trustworthy.

6. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. LINKDADDY LLC DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. LINKDADDY LLC MAKES NO WARRANTY REGARDING THE LEGAL SUFFICIENCY OF ANY MINTED CoC FOR ANY REGULATORY PURPOSE — THAT DETERMINATION IS MADE BY SARS, BMA, AND OTHER COMPETENT AUTHORITIES.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LINKDADDY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE PLATFORM, EVEN IF LINKDADDY LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LINKDADDY LLC'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Pinellas County, Florida.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
